Probate Properties

Stamp Duty Rebate for Probate Properties is a special provision within the realm of property taxation designed to provide financial relief to individuals inheriting property through the process of probate. This rebate serves as a valuable tool for easing the financial burden often associated with the transfer of assets following the death of a property owner.

What is Probate?

Probate, the legal process by which a deceased person’s assets are distributed among their beneficiaries, can encompass real estate, and the Stamp Duty Rebate comes into play specifically when real property is passed down to heirs or legatees. Stamp Duty Land Tax (SDLT) is a tax that typically applies to property transactions, including the purchase of real estate. However, when properties are acquired through inheritance due to a death, the UK government offers a Stamp Duty Rebate to mitigate the tax liability associated with the transfer.

If Probate applies to you, you may be entitled to a SDLT Refund

FAQs

The reality of Stamp Duty is that it’s a tax that you are required to pay, it usually takes a tax specialist to make sure everything is calculated correctly, especially if you own multiple properties (residential and non-residential) or land.

There are a list of things that could of resulted in overpaying stamp duty, if for example you property has:

  • Woodlands, a lake or more than 3 acres of land

  • Outbuildings, annexes and studio barns (must be self-contained)

  • Farmland or agricultural land

  • Equestrian land

  • Historic building or ruins

This list is non-exhaustive, there are other exemptions which may relate to you.

If you’re about to purchase a property or have purchased one in the last 4 years, then you could be eligible to claim a tax relief. (If you bought it more than 4 years ago HMRC won’t offer relief, but there are other avenues you can look at to get a tax reduction).

Solicitors and conveyancers are the norm when buying or selling a property, but they are not tax experts – at least 25% of people have overpaid and are due a refund.

Calculating what you’re actually owed and getting this back from HMRC are two completely different matters, you will need an expert like Stamp Duty Returns to examine your case.

Contact us today, our expert team can help calculate the amount of tax you’re due back from HMRC.

Almost everyone who purchases a property will have to pay stamp duty on the purchase, but there are exemptions. Conveyors and estate agents are not tax experts and 25% of home buyers will have overpaid.
